The release procedure

  • What is a release procedure?

    • This procedure enables the beneficiary of such prerogatives to buy property that is subject to the urban pre-emption right (or part of a deferred development zone, a public-interest statement or a reserved plot).­

    • Depending on the procedure, the administrative body may lose its pre-emption right if it does not purchase the property, may lose its right to expropriate, or may even be compelled to purchase the property as far as a reserved plot is concerned.

  • Find a notaire

    • Ask your notaire to advise you on the release procedure. He/she will examine the situation and give you valuable advice.
