A husband dies leaving his spouse, father and two brothers. How will the estate be devolved in case of renunciation of the father?

Article 734 of the French Civil Code fixes the orders of heirs, stating that the former exclude the following. In the presence of the spouse and father, the brothers are ousted (Article 757-1 of the French Civil Code).

If the father renounces, this waiver only benefits the spouse who then collects the entire estate (Article 757-2 of the French Civil Code).
