International legal cooperation

International action of the upper Council of Notaries is oriented around four objectives: :

  • Improve the legal situation of the populations in developing countries thanks to titling

    • Titling the board operates in several countries that have requested the notary to an audit and an action plan; the goal is to provide their citizens with reliable title deeds, and to fight against poverty. Thus, the notary is involved in the project of the French government to give Haiti a land registry. Audit reports on tenure security were handed over to governments of Tunisia, Madagascar, Togo and Colombia, together with surveyors; the recommendations on the three major economic centers of Vietnam were developed in partnership with Bull, IGN and ADETEF for the attention of the Vietnamese authorities in 2011. Work has been done in Montenegro with the United Nations Development Programme Development Programme (UNDP).

    • Notaries also participated in drafting "voluntary guidelines for responsible governance of tenure of land, fisheries and forests" adopted on 11 May 2012, with the United Nations Food and Agriculture Organization (FAO ); January 19, 2016, on French impetus, the International Union of Notaries signed a cooperation agreement with FAO to provide its expertise. Finally, the French notary is recognized as an expert by the World Bank in this area; every year, it is at its Annual Conference "Land and Poverty" on particular aspects of land management.

    • Beyond preserving the rights of local communities, these projects also help to fight against food insecurity and deforestation, and secure investments.

    • In urban planning and sustainable city, notaries in France, together with the surveyors, the university and the FNAIM, promote joint ownership as a sustainable management solution habitat, for the provision of a kit of the condominium. The notary has already worked with UN-Habitat and the World Bank on the subject.

  • Contribute to the training of notaries and lawyers for the rule of law

    • The Higher Council of French Notaries is related to notaries and foreign ministries of justice by 21 partnership agreements, which cover the Mediterranean countries (Algeria, Morocco, Tunisia), Asia (China, Mongolia, Vietnam, Cambodia, Thailand, Iran), America (Colombia, Haiti), Eastern Europe (Russia, Poland, Romania, Bulgaria, Serbia, Hungary) and Africa (Madagascar, Mauritius). On the African continent, the French notary in 1992 launched the Association of French Notaries which now has 25 member countries.

    • He also chaired until late 2013 the International Union of Notaries, which comprises 87 member states account for more than 2/3 of the world population and over 60% of the GDP of the planet.
      Since 2000, the notaries of 18 countries joined the International Union of Notaries, China to Bosnia and Herzegovina. This is a function expanding; in 60 years, members of the International Union of Notaries quadrupled. Countries that decide to establish a notary countries are reconnect with democracy and the rule of law, or by strong economic growth the country whose culture is based on writing. Today 14 members of the G20 know notaries and 22 of the 28 countries of the European Union.

    • For over 10 years was established Sino-French Centre for training and exchanges Notary and Legal in Shanghai, a joint venture between the Board of Notaries, the Court of Cassation, the French Ministries of Justice and Chinese and the University of Paris Assas. Four Guards French Minister of Justice visited the Centre (Mr. Perben, Mr. Clement, Dati and Mr. Mercier).
      This Centre aims to contribute to the political influence of France in China, in the legal field. Its action unfolds around three axes:
      - Training of Francophone Chinese elites, with the establishment of the Franco-Chinese Master of international business law;
      - Work expertise and exchanges on draft laws;
      - Finally, the awareness of researchers, lawyers and Chinese officials in the legal system and French law, with more than 4,500 lawyers and Chinese officials trained (www.cnfr-notaire.org).

    • Beyond China, more than 100 notaries from 12 countries that are hosted annually at the University of Notaries early September. The CSN also participates actively in the University of the African Notaries held annually since 2006 and successfully.

    • Notaries training activities were also carried out in Lebanon, Madagascar, Vietnam, Chad and Cameroon in the framework of European programs for judicial reform. especially trainings focused on the fight against money laundering were held in Romania, Benin, and Bulgaria.

    • Finally in 2006, the Higher Council of French Notaries organized the first conference of the Euro-Mediterranean notariats in Marseille.
      The event, which was a great success, was renewed in Antalya in 2008, in Algiers in 2010 and in Naples in November 2012 and Tangier city in March 2015.

  • Promote continental law

    • The law is the expression of a culture; as continental law is it the heart of the Roman-Germanic legal system. The CSN is a founding member and director of the Foundation for Continental Law (www.fondation-droitcontinental.org).

    • This especially holds every year since 2007, the Convention of Lawyers of the Mediterranean, the last of which was held in Rabat in October 2013, and a large summer university of continental law.

  • Inform French abroad

    • The French living abroad meet, under their wealth and tax family organization, the same problems that residents in France. In addition, they face under their property and their families in international matters.

    • The Higher Council of Notaries organizes in conjunction with the Ministry of Foreign Affairs, Legal meetings with the French overseas in consulates and embassies that have affected, since 2011, nearly 2,500 French in 20 countries.

    • The Higher Council of Notaries has also published a legal guide of French nationals abroad.
