My aunt, who was receiving ASPA, has just died. Can this allowance be recovered from the proceeds of a life insurance policy of which I am the beneficiary?

No. The solidarity allowance for elderly people (aspa) is, in principle, not recoverable from the proceeds of a life insurance policy. However, the relevant bodies may request that gifts made by the recipient after applying for the allowance be added back to the estate where they are manifestly incompatible with the resources declared by the insured person and are intended to prevent recovery from the estate (French Social Security Code, Art. D 815-6).

ASPA is recoverable from the portion of the net estate exceeding €105,300 (€150,000 in the French overseas territories), up to a limit that is revised each year.
