Live-in partnership


The common law provides no obligation to cohabitants does not provide automatic protection of one by the other, no joint liability of households or current liabilities.

  • What is live-in partnership ?

    • Long ignored by law, live-in partnership is legally defined since 1999 as a Union characterized by a common life with a character of stability and continuity, between two persons of opposite sex or the same sex, are living in couples.

  • The certificate of live-in partnership

    • The certificate of live-in partnership is not a contract and has very little legal value but may, if necessary, certify to the situation of the live-in partners.

    • It is issued free of charge by the town hall of the place of residence when receipts or invoices in both names, documents of ownership or even sworn statements are produced. If the municipality refuses to establish myself, live-in partners may submit a sworn statement to justify their concubinage.

  • The live-in partnership agreement

    • The livre-in partnership agreement is a contract whose contents may be chosen at will , the main end-purpose of which is to stipulate the conditions under which the partners live together. There are, however, far fewer advantages than a marriage contract or a civil solidarity pact (PACS).

    • In concrete terms, it is used to draw up an inventory of the property, particularly movables , each partner owns and to specify how the couple operates on a day-to-day basis (e.g. participation in joint expenses) and the conditions for dividing up the property if they separate.

    • But it does not govern the general ownership of property acquired during the common-law partnership (property will either belong solely to the person who purchased it or be jointly owned if purchased by both partners). Neither does it enable common-law partners to enforce personal obligations on one another.


In terms of common-law partnerships, the law does not recognise any obligations of faithfulness, cohabitation or assistance. Common-law partners are prohibited from drawing up agreements enforcing any such obligations.
